RIDE MY CARS TERMS AND CONDITIONS

1.1 Governing Entity & Jurisdiction: This Agreement is governed by and construed in accordance with the laws of the State of Delaware, United States, and the applicable laws of South Africa and Ghana for regional operations operated by New Development Finance Group LLC/PTY.

1.2 Regional Regulatory Frameworks: Operations in the United States comply with federal and state commercial codes; operations in South Africa comply with the Consumer Protection Act and National Road Traffic Act; operations in Ghana comply with the Road Traffic Act and Data Protection Act, 2012 (Act 843).

Ride My Cars is a technology intermediary platform connecting independent service providers with users across four core service verticals:

3.1 Technology Intermediary Model: Service providers (drivers, chauffeurs, vehicle hosts, and couriers) are independent contractors and not employees, agents, or partners of New Development Finance Group LLC/PTY.

3.2 Provider Compliance Responsibilities: All service providers must independently maintain valid driver operator licenses, criminal background check clearances, vehicle registration, commercial insurance policies, and roadworthiness certificates.

4.1 Passenger Conduct: Users must refrain from smoking, consuming alcohol, damaging vehicles, or abusing service providers during rides and chauffeur engagements.

4.2 Provider Verification Obligations: Unapproved or expired driver licenses, insurance policies, or safety certificates automatically result in account suspension until administration re-approves credentials.

5.1 Fixed 10% Platform Service Fee: Ride My Cars charges a fixed 10% platform commission on all completed Ride hailing trips, Chauffeur bookings, and Package Deliveries. Vehicle rental commissions follow specified owner listing tiers.

5.2 Payment Gateways & Tax Obligations: Supported payment gateways include Stripe (USA), PayFast / EFT (South Africa), Paystack / Mobile Money (Ghana). Service providers are independently responsible for all income tax, VAT, and statutory reporting.

6.1 Data Processing: Personal data is processed in accordance with our Privacy Policy and statutory data protection frameworks (CCPA, POPIA, Ghana Act 843).

6.2 Data Rights Portal: Users may manage consent or submit statutory personal data export/deletion requests via the Privacy Data Rights Portal.

7.1 "AS-IS" Platform Basis: The platform operates on an "AS-IS" and "AS-AVAILABLE" basis without guarantees of error-free operation.

7.2 Monetary Liability Cap: To the maximum extent permitted by law, the total cumulative monetary liability of New Development Finance Group LLC/PTY shall not exceed $100 USD (or local currency equivalent).

Accounts may be suspended or permanently deactivated for fraud, safety violations, discrimination, harassment, or breach of these Terms. Blocked users are restricted from accessing platform services.

Ride My Cars reserves the right to modify this Agreement at any time. Continued platform usage following published updates constitutes binding acceptance of the revised Terms.

10.1 Prohibited Consignments: Packages must NOT contain narcotics, firearms, explosives, flammables, cash, bullion, biohazards, or stolen items. Couriers reserve the right to inspect exterior packaging and reject non-compliant items.

10.2 Delivery PIN Verification: Delivery completion requires input of the recipient's 4-digit PIN into the application to establish verified chain of custody.

11.1 Digital Pre-Inspection: Renters and hosts must complete digital inspection photos, odometer readings, and fuel logs before handover.

11.2 Security Deposit Holds: Pre-authorized security deposit holds cover potential damages, fuel shortages, or late return penalties in accordance with our Refund & Cancellation Policy.

12.1 72-Hour Dispute Rule: All dispute claims, fee challenges, or damage reports MUST be submitted within 72 hours of service completion or cancellation via the Dispute Portal or sent to disputes@ridemycars.com.
